摘 要:本文认为要使文明冲突背后的价值观冲突给人类和平秩序带来的威胁降到最小,需要思考一种文明共融的理想。这种理想会形成反对价值观输出的国家工具性、重建价值观形成的文化正当性和承认价值观创造的文化交互性三个价值观新视角。它们将成为重构东亚概念及东亚法哲学的文化前提,从而为东亚法哲学的存在意义和发展愿景提供新的可能。In order to minimize the threat to the peaceful order of mankind,which was brought about by the conflict of values behind the clash of civilizations,this paper argues that an ideal of communion of civilizations is needed. The ideal forms three new perspectives of values: the national instrumentalism that opposing the output of values,the cultural legitimacy formed by the rebuilding of values,and the cultural interaction created by the recognition of the values. The three will be the cultural premises of reconstructing the concept of East Asian and the East Asian philosophy of law,providing new possibilities for East Asian philosophy of law,both to its meaning of existence and its vision of development.
