摘　　要：我国体育中介市场经过20多年的发展,已逐步形成不同服务内容和领域互相联系的体育市场体系。这些体系包括经纪服务市场、咨询服务市场和监督服务市场。由于我国认证系统的建立和发展都有着特殊的历史背景,一些第三方认证机构有着"半官半民"的特点,又因为法律地位不明确,第三方体育服务认证机构无法为出具错误、甚至虚假的检测数据报告而导致的事故或责任独立承担民事法律责任,其中包括赔偿责任。建议:通过立法,要求服务提供者执行强制性标准和非强制性标准结合的模式,推广自己的服务和信誉,提供优质的服务;让第三方体育认证机构成为真正的法人主体资格,承担相应的赔偿责任;涉及体育设施和设备、健康和卫生、安全保障和环保指标的服务项目,应将体育服务认证中要求达到的硬件部分前移,将开放条件认证放在开馆营业之前,对服务质量保障体系的软件要求放在营业之后,进行常规监督。Over 20 years of development witness sports market system, in which such different services as brokerage services, advisory services and supervision services intertwined with each other. Special historical background however brings about problems. Firstly, some third party certification agencies are characterized by being half state - owned and half private. Secondly, as their legal status is not clear, these agencies are prone to supply unreal or even falsify test data or reports for both sides leading to accidents which entail business bearing civil liability independently. Therefore, suggestion is given as fol- lows. Firstly, Law and regulations shall be there to require service providers to perform in line with a combination of manda- tory and non- mandatory standards mode. This is to promote their services and credibility and to provide quality services. Secondly, let these agencies be with the real corporate main qualification, bearing them corresponding compensation respon- sibility. Thirdly, the service items related to sports facilities and equipment, health and sanitation, safety and security and environmental indicators or index shall be guaranteed as to place hardware requirements ahead of licensing date while the software on service quality guarantee system is placed after the opening of business but being under supervision routinely.
