我国退役运动员劳动就业权的理论探析

摘　　要：从理论的视角研究通过系统分析劳动就业权的内涵,认为退役运动员这一特殊群体依法享有平等的选择职业和平等就业权等权利。就业的机会平等是其特殊含义的体现,其基本内容为就业机会均等,禁止就业歧视和合理的差别对待。从实践的视角,研究讨论了运动员作为"国家意志的执行者"这一职业的特殊性,并进而结合社会权和生存权两项基本人权系统分析了对退役运动员实行"倾斜保护"的理论依据。同时结合当前我国退役运动员再就业途径及现实困难分析了制度保障存在的问题,指出了立法保障的迫切性和重要性。认为探讨退役运动员的劳动就业权,不仅关系竞技体育可持续发展问题,更体现了社会对这一特殊群体的"人文关怀",也是构建和谐、公正、可持续的大文化事业发展的基本理论问题之一。Theoretical analysis on the connotation of labor employment rights allows this study to find that the retired athletes, a special group, are entitled to equal career choice and equal employment rights. Its special meaning is about equal employ- ment opportunity with the prohibition of employment discrimination and promotion of discriminatory methods. This article find that, as the ＂national will＂ , the athletes＇ profession has its particularity, and analyzing the two basic human rights, namely, the social rights and the right to exist. It is concluded that the retired athletes should enjoy ＂tilt protection＂. Meanwhile, problems exist in guarantee system after analysis of the retired athletes＇ re - employment means and realistic difficulties. The article thus points out the urgency and importance of legislative protection. Finally, this kind of employment not only concerns the sustainable development of competitive sports, but also reflects the ＂humanistic care＂ for this group of people from the society, and it is also one of the basic theoretical issues in constructing a harmonious, fair and sustainable cultural atmosphere.
