摘　　要：专利与技术标准的融合使专利技术能够借助技术标准的特殊地位得到更广泛的应用,同时也使某些技术标准借助专利保护实现事实上的垄断。专利与技术标准的融合是经济发展的必然要求,也是必然趋势,在这种趋势下必然出现技术陷阱问题,即技术标准中专利权滥用。从专利与技术标准的关系出发,分析在专利技术与技术标准融合趋势下,技术标准中专利权滥用的多种形式,从企业竞争力及发展的角度,提出规避陷阱的措施。The combination of patent technology and technical standards makes patent technology get more extensive application in terms of the special status of the technical standards, and also makes some technical standards achieve facto monopoly via the aid of the patent protection. The integration of patent technology with technical standards is an inevitable requirement of economic development, also is an inevitable trend. Under the trend of integration development there are trap problems of technical standards. The abuse of the patent right in technology standard has a variety of forms. This article from the relationship between patent technology and technical standards, following the integration trend, analyzes the various forms of the abuse of patent right in technical standards. From the angle of competitiveness and development of the firm, measures to avoid technical standards traps are put forward.
