现代大学制度建立与运行的法制保障研究

摘　　要："没有无权利的主体,也没有无主体的权利";法制保障是现代大学制度建立与运行的"护身符"。这种法制保障须从三方面建立:一是赋予大学法人主体地位;二是建立现代大学法人治理结构,充分发挥校长依法治校的作用,并建立起董事委员会对校长行为进行监督管理的机制;三是制定大学法人治校章程。“There is no subject without a right ,and no right without a subject”.Legal guarantee is a protection of Modern University System ’ s establishment and operation .The legal guarantee should be established from three as-pects as the following：firstly ,we should give university a legal person status;secondly ,we should establish the gov-ernance structure of Modern University , give full play to the role of the principal who operate the universities by laws,and establish Board committee mechanism to supervise and regulate the principal ’ s behavior;thirdly, we should establish the University Charter for the governance of university .
