摘　　要：正确理解宽严相济刑事政策及其与量刑情节适用的关系,在宽严相济刑事政策的指导下正确适用量刑情节,是司法实践部门面临的重要课题。本文试图对此进行系统地探讨,以引起审判人员对宽严相济刑事政策的重视,树立政策意识,正确理解和发掘宽严相济刑事政策背后的蕴涵,将有利于宽严相济刑事政策的有效构建及其保护和保障双重功能的实现,同时促进宽严相济刑事政策在理论和实践上的可持续发展。How to comprehend the theory of tempering justice with mercy police law and its relation- ship with sentencing plot application and how to correctly utilize sentencing plot guided by the temper jus- tice with mercy aiming to correctly sentence are the major issues faced by the judicial practice department. This tries to investigate this systematically in order to draw judges attentions to the policy, establish the awareness of policy, understand and explore the implications of tempering justice with mercy police law. These are advantageous to construct the policy effectively, protect and guarantee the implementation of the dual functions, meanwhile promote the sustainable development of tempering justice with mercy police law theoretically and practically.
