宪法实施的三大误区

摘　　要：建国60年来我国宪法的实施状况不尽人意,原因是多方面的,其中与国人包括宪法学者对宪法实施的认识存在误区有很大的关系。为"把全面贯彻实施宪法提高到一个新水平",我们必须走出宪法实施的误区:过分强调违宪审查的宪法实施方式;排斥宪法实施方式的新探索;机械理解有关宪法实施的宪法条款。并且,应当突破思想禁锢,积极探索包括合宪性解释在内的各种宪法实施的新方式、新路径及新机制。The implementation of our constitution has been unsatisfactory in the past 60 years for various reasons, but an important reason is that Chinese people, including our constitutional scholars, have some misunderstandings on the implementation of the constitution. To ＂ uplift the full implementation of the constitution to a new level＂, we must go out of these misunderstandings： putting too much emphasis on the judicial review of constitution; rejecting the new exploration on the implementation of the constitution;mechanical understanding of the constitutional provisions on the implementation of the constitution. And, we should break through the confinement of thought, and actively explore new methods, new paths and new mechanisms of constitution implementation.
