摘 要:从不动产登记制度不统一的现状出发,并结合中国既有的试点经验及相关域外经验,认为应当以不动产登记之公示公信作用为根本原则,通过整合既有的不动产登记部门职能至国土部门,并在一定时期内逐步完成不动产状况的调查核实,通过统一"字段"建立不动产数据库,并在此基础上借力互联网信息技术,建立统一化的不动产数据平台,为当事人、利害关系人及有关机关之查询、调取提供统一平台,逐步实现不动产之统一登记,以提高物权之公示公信效能,简化不动产相关的行政管理程序。Based on the non-unified status of real estate registration sys- tem, the pilot experience in China and relevant foreign experience, the paper thinks that the basic principle lies in the publicity and credibility effects of the real estate registration. Moreover, the functions of the current real estate registration departments should be integrated into the land departments while the real estate status should gradually be investigated and verified in a given period. We need to set up a real estate database with unified information, on such a basis may we establish a unified platform of real estate data with the Internet information technology, which can not only provide convenience for involving parties, interested parties and related institutions to check and obtain information, but also improve the publicity and credibility effects of Real Rights and simplify the ad- ministration procedures related to real estate.
