摘　　要：最高人民法院发布的刑事指导性案例要获得"共同体共识",就必须符合《关于案例指导工作的规定》的条件。从第一批刑事指导性案例开始,尽管每个案件裁判要点中包含了入选案件适用法律的基本意见,但是在定罪指导性、法律适用指导性和文书形式指导性等要素方面并不明确,因而难以最大程度地发挥指导性案例的应有功能和价值。以"潘玉梅、陈宁受贿案"为样本分析刑事指导性案例在指导性要素上如何加以改善的问题,或许能够促进我国刑事案例指导制度走向成熟。The leading criminal cases issued by The Supreme People＇s Court must satisfy every condition regulated in Regulations on the Practice of Leading Cases if they can reach a consensus of the legal community . From the beginning of the first batch of leading criminal cases , each selected case has its basic legal advice in the judgment point , but there are some ambiguities in guiding factors concerning the conviction , legal application and the type of document . As a result , they do not achieve the functions and values which we expect the leading cases ought to achieve at utmost . Based on the bribery case of Pan Yumei and Chen Ning , the author of this paper discusses how the leading cases can at best be improved in terms of the guiding factor . We hope that the study can push the system of leading criminal cases in China more perfectly .
