附条件不起诉制度若干问题之思考

摘　　要：为了保护未成年人这一特殊群体,新《刑事诉讼法》增加了对涉嫌刑法分则第四章、第五章、第六章规定的犯罪,可能判处一年有期徒刑以下刑罚,符合起诉条件,但有悔罪表现的未成年人适用附条件不起诉的制度。该制度体现了刑罚的谦抑性,在程序分流、合理配置司法资源、有效改造犯罪嫌疑人等方面有着积极的功效。但是附条件不起诉制度也存在着适用对象范围过窄、适用条件过于简单、附加条件内容不明确等问题。因此,有必要在借鉴国外立法并总结我国实践经验的基础上,从适当拓宽附条件不起诉制度的适用对象范围、细化附条件不起诉制度的适用条件、明确附条件不起诉制度所附加条件的内容等方面予以完善。In order to protect minors, new Code of Criminal Procedure increased the system of conditional non -prosecution to protect minors who were suspected of criminal law offenses Chapter IV, Chapter V, Chapter VI regu-lations, sentenced to be in prison for one year, and showed repentance. The system reflects the penalty modesty,diversion program, the rational allocation of judicial resources, and the effective transformation of the suspects hasplayed a positive effect. However, the range for applicable targets of conditional non - prosecution system are toonarrow, the applicable conditions are too simple, content of additional conditions is not certain. Therefore, weshould analyze this system deeply and build up our own conditional non -prosecution system based on new criminal pro-cedure law by referring to legislations and provisions in other countries and in conjunction with the judicial practice.
