法官刑事司法行为的道德影响及限度

摘　　要：刑事司法行为是法官依照法定审判程序行使司法审判权的活动,这一过程体现了法官对刑事案件进行道德价值判断和道德基本观念的选择,因此,道德为法官公正裁判提供了价值标准,是实现刑事司法行为公平正义的基础,也有利于刑事司法判决更符合人性要求。但是法治社会下法官不能以道德标准代替法律标准,应当注重把握刑事司法中道德影响的合理限度。The criminal justice act refers to the action that judges perform the exercise of jurisdiction in accordance with legal proceedings,which embody the judges＇ moral judgments and their choice of basic moral ideas in criminal cases.Therefore,morality provides the judges with the value standards for fair judgments,is the basis for realizing the fairness and justice of criminal justice,and is beneficial in order to make the criminal judgments more conformed to the humanity requirements.But in the legal society,judges cannot replace the legal standards with moral standards,and should focus on the good mastery of the reasonable limitation of the moral impacts in the criminal justice.
