中国再生资源产业知识产权运用机制顶层设计

摘　　要：2008年,《国家知识产权战略纲要》首次将知识产权运用的能力提升作为知识产权工作的重点。站在产业层面研究如何通过提升产业知识产权运用能力促进再生资源产业持续健康发展。根据废弃物再利用中所涉及知识产权性质的不同,将再生资源产业分为再制造产业和再生产产业。从再生资源产业链出发,梳理知识产权运用关联主体,包括原产品制造商、再利用商、消费者和政府,各主体间存在利益冲突,难以形成科学合理的知识产权运用机制。以机制设计理论为指导,以顶层设计理论为方法,自上而下系统设计再生资源产业知识产权运用机制,包括促进机制、支持机制、共享机制和拉动机制,勾画再生资源产业知识产权运用机制蓝图并提出发展意见和建议。The capacity of using the intellectual property is more and more important in the society, especially after the national intellectual property strategy compendium issued by the State Council in 2008. Therefore, the intellectual property is an important factor to the sustained and healthy development of renewable resource industry Meanwhile, rather than the native resources, renewable resource industry regard the recovery of waste as its raw material application, so there are some differences in the use of intellectual property in renewable resource industry. According to the differences in the use of intellectual property, the renewable resource industry can be subdi- vided into two parts： the remanufacturing industry and the rebuild industry. Based on the renewable resource industry supply chain, there are four stakeholders in the use intellectual property in renewable resource industry： the original manufacturer, the recycle manufacturer, consumer and government, and also there conflict of interest between each of the others. Under the guide of mechanism design and top-down design, an use mechanism of intellectual property is structured for renewable resource industry, including promotion mechanism, support mechanism, share mechanism and pull mechanism
