摘　　要：我国传统林地管理法律制度形成于计划经济时期,已不适应市场经济条件下发展现代林业的要求,存在立法理念滞后、行政权配置不合理等问题,需要树立生态文明理念,提升林地管理法律制度在林业法制体系中的地位,构建新型权利义务关系,形成适应现代林业发展要求的法律制度体系。The traditional forestland legal system was formed in the planned economy period in China, it has not adapted to the development of modem forestry under the condition of market economy, some contents are not reasonable, such as the legislative idea, administrative allocation etc, need to establish the concept of ecological civilization, to upgrade the status of forestland legal system in the forest law, constructing the new relationship between the rights and obligations, so as to adapt to the requirements of the development of modem forestry.
