体育赛事转播权的法律属性研究

摘　　要：采用文献资料、逻辑思维和案例分析等方法对国内外体育赛事转播权法律性质界定存在的赛场准入权说、娱乐服务提供说、企业权利说和商品化权说等观点分析。结果显示:体育赛事转播权法律性质的多学说论和各类法律权利的交叉使得赛事转播权的归属存在着不确定性。为明确体育赛事转播权法律性质及其权利归属,需要对体育赛事转播权和体育赛事节目分开讨论,它们是两种不同性质且容易混淆的权利,两者权利归属不相同,法律保护方式有区别。体育赛事转播权归属于体育赛事参赛组织和体育赛事主办单位,享有许可他人进驻比赛现场进行拍摄、转播体育赛事并获得经济利益的权利,是体育组织的无形资产,接受《合同法》和《侵权责任法》保护;体育赛事节目归属于广播组织,是经体育赛事组织授权转播体育赛事的持权转播商(包括电视台、新媒体机构)播放的体育赛事信号,具有广播组织权,其权能在于禁止他人有线和无线转播其节目信号,接受《著作权法》和《信息网络传播保护条例》保护。The article analyzes the legal character demarcation of sports events at home and abroad and their broadcast right by the methods of literature,logical thinking and case analysis. The results showed that the intersection in multi doctrine about legal nature of broadcast right of sports events and various types of legal rights made uncertain of the ownership of broadcast right of sports events. In order to clarify the legal property of broadcast right of sports events and its vesting rights,we need to discuss them separately. Because these two kinds of rights are different and easy be confused. Broadcast right of sports events attributes to sports events participating organizations and sports events organizers. It is entitled to permit others to enter the competition scene to shoot,broadcast sporting events and get the economic benefits. And it’s intangible of sports organizations,protected by“Contract Law”and“Tort Liability Law”. While sports programs belong to broadcasting organizations,including television and new media agencies. It is authorized by the sports events organizations and held the right to broadcast sports events. Sports programs still have the right of broadcasting organizations,and the right to prohibit others to relay their program signals by wired or wireless broadcasting, accepting the protection of“Copyright Act”and“Regulations on the Protection of Information Network Dissemination”.
