摘　　要：北魏宗室特指拓跋始祖神元帝力微的全体后裔,他们是统治集团的核心力量,也是凌驾于社会之上的特权阶层。宗室犯罪是困扰皇朝国家的难题,一方面必须使用刑罚,依法惩治,以维护社会秩序;另一方面又碍于皇族的情面,在量刑及执行过程中刻意保留回旋余地,妨害了司法公正。皇帝试图寻求二者的平衡,却在不经意间亲手敲开制度的漏洞,这是一切专制政体永远无法解决的矛盾。The extension of the royal clan group of the Northern Wei Dynasty was all the descendants of the Tuoba ancestor the Shenyuan Emperor Liwei .They were the core of the ruling class and the privileged stratum .The crime of the royal clan was a serious social problem and punishment should be used in order to keep public order . But in view of their special status , the government usually abused the law and practice favoritism , which was a con-tradiction that couldn ’ t be resolved for all despotism .
