人大监督司法之困境及其消解

摘　　要：人大监督司法的职能一向处在较为薄弱的状态,这不仅影响了人大及其常委会监督职能的全面发挥,同时还制约了人大及其常委会所享有的其他法定职能之发挥。目前人大监督司法的职能亟待强化,以完善我国的司法监督制度体系,提升司法公正性和权威性。突破的重点应当置于法律监督深入化、工作监督常态化和人事监督实质化等三个层面加以考虑,并同时强化人大监督司法的公开化、规范化和民主化等方面的制度建设。The function of People＇s Congress＇ ssupervision on judicial authority has always been so weak, which not only impedes the oversight function of People＇s Congress and its Standing Committee into full play,but also restricts their other roles. Thesupervisionof People＇s Congress on the judicial authority should be strengthened, in order to improve our judicial supervision systemand to promote judicial fairness and authority. The points are to deepen the legal supervision,to normalize worksupervisionand to perform staff membership supervision. At the same time,it is important to strengthen publicity,normativity and democratization of the supervision.
