契合与冲突——我国内外宪法人口制度探析

摘　　要：宪法人口制度是在人口活动领域中所应遵循的最高规范体系,它可以分为外在宪法人口制度和内在宪法人口制度:外在宪法人口制度主要表现在宪法文本中,由与人口活动的相应条款构成;内在宪法人口制度则主要是由人们在日常人口活动中自觉遵守的习惯、习俗和伦理道德构成。外在宪法人口制度变迁的过程,就是一个与内在宪法人口制度由冲突达致契合的过程。通过对内外宪法人口制度的探析,追究两者冲突与契合之处,以期消弭冲突、达致契合之境。The population system in the constitution is the highest standard system. It can be divided into extemal and internal systems： the external mainly consists of the corresponding terms and population activities; the internal is mainly composed of people consciously who abide by daily population activity habits, customs and ethics. This study aims to bring harmony to the two different systems.
