摘　　要：婚姻伴随人类的发展而变化,从伦理关系演变为法律关系,婚姻在现代社会仍然是重要的法律关系。研究婚姻问题需要从婚姻法律学涵义入手,厘清学界一些争议,明确法律婚姻的几个要素:两性结合,自愿前提,夫妻身份的公示性,合法结合的社会性。婚姻在法律社会需要法律规范和法律保障,这对于维护婚姻的稳定性和构建和谐社会具有积极意义。Marriage changes from the ethical relationship to legal relationship associated with human development.It is still an important legal relationship in the modern society.Researching marriage problems needs to start with the marriage law meaning,discuss the academic controversy, clarify several factors of legal marriage such as a union of a man and a woman,voluntary premise, public nature of the relationship of husband and wife,and sociality of legal union.Marriage needs legal norms and legal protection in legal society,so that it has a positive significance to maintain the stability of marriage and build a harmonious society.
