摘 要:宅基地置换有其法律本质,体现了公共信托理论和利益平衡理论,然而现实中农地发展权制度缺失、宅基地产权制度缺陷、宅基地置换相关法律制度不完善和公众参与制度缺失等导致了宅基地置换中农民权益受损。宅基地置换中农民权益保护的法律建议:构建农地发展权制度;完善宅基地产权制度,明细农地产权,加快宅基地流转市场化建设;完善宅基地置换相关法律制度,包括在法律中明确宅基地的置换补偿、合理确定宅基地置换补偿的范围和标准、建立宅基地置换的约束、监督机制等;建立有效的公众参与制度。The replacement of homestead has its essence of law, which represents the public trust theory and interest balance theory. However, in reality, the lack ofsystemfor farmland development right, the imperfection ofhousing land property system, poor relevant institution regarding homestead replacement, and the scarcity of system for public participation are the main constituents which result in the damage of rights and interests of peasants. In response to this, this paper offers some legal advices to protect the farmers' rights and interests in the process of homestead replacement. These include: buildingthe system forfarmland development rights; improving rural residential land property rights system and making detailed farmland property right so as to accelerating the efforts to developing the marketization of land circulation.In addition, the relevant legal system must be improved, this means that in the law, we must make the compensation for homestead replacement clear, determine the compensation scope and standards reasonably, establish constraint and supervision mechanism, as well as effective public participation system.
