摘 要:农民工和私营企业主是改革开放以来出现的新社会阶层,也是农民工与受雇私营企业劳动关系的两大基本劳动关系主体。农民工与受雇私营企业劳动关系当前存在劳动争议高发频发、劳动合同缺乏规范、劳资双方沟通协调机制缺乏、社会保障覆盖率低等突出问题。其主要成因在于农民工非正规就业导致其身份地位不平等、企业内部劳动关系协调机制欠缺导致劳资冲突、社会保障制度缺陷导致农民工保障面扩展缓慢。构建农民工与受雇私营企业稳定和谐的劳动关系,需要政府、企业及社会协同治理。治理中,可将对私营企业的规范化管理作为关键环节,将组建工会和构建三方调节机制作为主要途径,将完善与农民工相关的保障制度作为重要内容。Migrant workers and owners of private enterprises are not only the new social strata that emerged since China's reform and opening up but also two prime bodies of labor relations. Currently labor conflicts occur at a high frequency; problems involve nonstandard labor contracts,absence of mechanism for communication and coordination between labor and management,low coverage of social security,etc. The main causes lie in the unequal status due to irregular employment,insufficient internal labor-management coordination,and tardy expansion of social security coverage of migrant workers due to defective social security systems. The establishment of stable and harmonious labor relations between migrant workers and private enterprises needs joint efforts from the government,enterprises,and the society. Standardized management of private enterprises should be taken as the key link for the solution,a tri-party meditation mechanism including the trade unions as the major approach,and the improvement of the social security system related to migrant workers as the main content.
