农村土地产权认知的三重维度及其内在冲突——理解当前农村地权冲突的一个中层视角

摘　　要：新世纪以来,中国农村的地权冲突数量急剧增加,成为影响农村社会稳定的主要矛盾类型。通过对L镇土地确权冲突案例的调查和分析,本文发现,当前对农村土地产权的界定规则主要存在公有产权规则、私有产权规则与家业产权规则。这三种产权规则折射了人们对土地产权认知的三重维度,即政治维度、经济维度与社会(文化)维度。中国当前的农村地权冲突主要表现为土地产权规则之争,而其背后反映的是人们土地产权认知维度的变化——由政治维度为主导逐步转向政治、经济与社会(文化)三重维度并存。As new century coming, the conflicts on land property rights have sharply emerged in rural China, and became a major kind of contradiction influencing the stability of rural society. Through investigating the cases of conflicts on land property rights in L town, the paper finds that there are three main types of rural land property rights defined rules, namely the rule of public property rights, the rule of private property rights and the rule of inherited property rights. These three property rights defined rules reflect respectively the political dimension, economic dimension and society(culture) dimension of land property cognition.But they in essence reflect the change of social cognition on the meaning of land property rights that people no longer completely understand land property rights from the perspective of political, while value the land property rights with political, economic, social(culture) dimensional understanding. This is the deep cause of the current conflicts on land property rights in rural.
