摘　　要：如何完善劳教制度废止后相应的法律制度,是摆在当前迫在眉睫的重要工作。"保障人权"是后劳教时代矫正制度的核心要素,而"完善司法制度"则是后劳教时代矫正制度的有效手段。要真正做到保障人权、完善司法制度,则需要构建以注重程序正当为原则,以信息公开为手段和保障的违法行为矫治制度,从立法、司法到执法每一道程序都以公开对接民意,从而促进我国人权司法保障制度的建设。How to perfect corresponding legal system after reeducation through labor system is abolished is an impor- tant work in the current time. ＂Human rights＂ is a core element of correction system, and ＂perfecting the legal system＂ is an effective method. In order to protect human rights and improve judicial system, it is necessary to construct illegal behavior correction system that is based on proper procedure principle and takes information disclosure as means and guarantee, along with opening information to the public opinion in every process from the legislative, judicial and law enforcement, so as to promote the construction of the judicial guarantee of human rights system in China.
