试论检察机关行政法制监督制度的完善

摘　　要：检察机关行政法制监督制度对于保证行政机关依法行政以及国家依法治国方略的实施具有重要意义。但当前,我国检察机关行政法制监督仍存在着监督范围偏小以及被动监督等问题。因此,应建立并完善检察机关对行政处罚案件的审查制度、行政公益诉讼制度、检察机关对监察、审计案件的审查制度,扩大检察机关的监督范围,使之更好地担负起保障人民利益的重任。The administrative legal supervision system of procuratorial organs is very important to ensure that the administrative or-gans implement administration according to law and our country carries out the strategy of ruling by law.There are some problems inthe administrative legal supervision in current China such as the scope of supervision is smaller than what it should be and thepassive supervision issues leading to the administrative legal supervision of procuratorial organs do not work as well.Therefore,weshould establish the review system of procuratorial organs to check the cases of the administrative punishment,the administrativepublic lawsuit and the review system of procuratorial organs to check the case of the government watchdog and audit to expand thescope of supervision.And we should establish supervision system of guarding against administrative violation to change the passivesupervision to active supervision ,all of them will improve and perfect the administrative legal supervision of procuratorial organs ,andprocuratorial organs will do better in protecting civil interests.
