摘　　要：政府在专利治理中存在缺位和错位现象,不仅使政府财政浪费严重,滋生信任危机,而且导致专利市场发育畸形,缺乏竞争动力。要改变现状,政府须从以下方面努力:专利治理中引入非营利组织,打破垄断局面;扩大专利管理机构设置范围,培养专业人才;充分利用电子政务信息平台,促进信息流通;努力建构专利危机管理机制,提高风险意识。The government exists the phenomena of role absence and role reversal in the process of patent govern- ance which not only make a serious waste of government finances and breed crisis of mutual trust, but also lead to the malformations of patent market and the lack of competitive dynamics. In order to change the current situation, the government should take the following actions as introducing non-profit organizations to break the monopoly in the process of the patent governance, expanding the scope of patent management institutions and training professionals, taking full advantage of e-government information platform to facilitate the flow of information and making an effort to construct the patent crisis management mechanism to improve risk awareness.
