摘　　要：中国目前几乎没有基于商业成功证明发明或实用新型具备创造性从而获得专利保护的案例,但美国因主张在商业上获得成功而具备创造性的案例却时有出现。文章介绍了中美两国涉及商业成功的两个典型案例,并从专利法角度进行了简要分析,以期为相关人员提供参考。China at present almost no commercial success has proved an invention or utility model has creativity so as to obtain patent protection based on the case,but USA for advocating succeed in business and creative case but there. This paper introduces the two countries involves two typical eases of commercial success, and from the perspective of patent law is briefly analyzed, in order to provide reference for the related personnel.
