摘　　要：知识产权的形而上特点使得拥有资源的发达国家借助于知识产权制度来抵制部落群体对知识产权财产规范要求变革的主张。传统文化表达的特殊性导致它很难被纳入著作权框架中,企图以著作权制度为基石构建传统文化表达保护方式只能让二者之间的矛盾更为突显。传统文化表达与作品之间存有一定相似性,在建立传统文化表达权利保护框架时,可以沿用著作权法的立法思路和方式。但传统文化表达的保护又不应拘泥于著作权制度的藩篱,而应根据自身特点,建立特殊权利保护模式。Metaphysical characteristics of intellectual property make the developed countries that have the resources reject the tribal groups＇proposition for changing the intellectual property norms. Particularity of traditional cultural expression causes it difficult to be included in the framework of copyright , the copyright system as the cornerstone of an attempt to build protection of traditional cultural expressions can only make more prominent contradiction between them. A certain similarity between the traditional cuhural expression and works make the legislative ideas and methods can follow copyright law, when law create the right framework for the protection of traditional cultural expressions. However, the protection of traditional cultural expressions and barriers should not rigidly adhere to the copyright system , and establish protected mode of special rights by its own characteristics.
