摘　　要："三农"问题的根本在于农村,而其焦点在于农地产权流转创新及其市场化程度,受制于历史习性、制度特性(制度模糊、产权权能虚置)等约束,我国的农地经营流转制度还很不完善。作为农民最重要的"财产",农地产权市场化流转的关键是解决农地资产产权的权能配置及其合约激励问题。不同的合约权利结构(S)决定经济制度及其变迁(I)的本质,而主体行为选择(C)的方向及其获得的绩效水平(P)既是制度创新的结果,又是引致制度变革的原因。文章整合多学科理论,以承包合约的静态与动态权利结构分析为起点,提出基于"权利结构—制度变迁—行为选择—绩效"之联动关系逻辑的"SICP"范式,为新形势下我国农地产权流转制度的实践创新提供理论框架和政策参考。The root of the Chinese agricultural problem lies in rural areas ,but its focus is on the innovation of agricultural land property rights transferring and its degree of marketization .Subject to the historical habits and in-stitutional characteristics （“Fuzzy system”,empty of the functions of property rights ） and other constraints ,the agricultural land transfer system in China is still far from perfect .As the most important “property”of China’s o-verwhelming majority of farmers ,market-oriented agricultural land ownership ,allocation of the functions of prop-erty rights and the contract incentives are the key to the solution path of land property rights transferring .The dif-ferent contractual rights structure determines the nature of the economic system and its changes ,and the direction of the actors＆#39;behavior choices and their performance level not only are the result of institutional innovation ,but al-so the causes of institutional change .Starting from the analysis of the static and dynamic structure of the contractu-al rights ,and following the logical linkage relationship of “right structure-institutional change-behavior choices-performance”,and based on the integrated use of multi-disciplinary theories ,the paper created “SICP” analysis paradigm and tried to provide a theoretical framework and policy reference for the existing and future practice or in-novation in Chinese agricultural land transfer system .
