我国土地契约发展历史考察——基于地方政府作用的视角

摘　　要：从地方政府在土地流转中的作用视角,利用历史回顾法和比较分析法,考察我国土地契约发展的历史,以期为当前农地流转中地方政府的作用定位提供思路和建议。研究发现土地契约制度发展历程大致可分为萌芽、定型和成熟三个时期,其作用主要体现在土地权属的确定、交易程序的规范、契税制度和交易后权利保障等方面。土地契约制度的发展具有延续性,也是一个不断完善的过程,即使局限于当时土地制度的弊端,但对于当前土地交易尤其是农地流转的相关制度建设仍具有一定的启示和借鉴作用。研究结论认为当前地方政府应当从契约订立、中介组织建立和民间契约吸纳等方面的加强农地流转管理。Based on the methods of historical survey and comparative analysis ,we survey the history of the de-velopment of China’s land lease ,so as to provide ideas and suggestions on positioning the role of the local govern-ment in current circulation of agricultural land .The research results show that the course of the land contract sys-tem could be divided into three periods ,namely bud ,shape and mature ,and the function of the system mainly lies in determining land ownership ,specify transaction process and tax system ,and protecting the rights of the parties concerned after transaction completed ,etc .The land contract system is developed with certain continuity and con-stant improvement ,even though confined by the shortcomings of the land system in different periods of time ,it can still provide some inspiration and reference for current land transactions ,especially the building of related regu-lations for circulation of agricultural land .The current local government should strengthen management of circula-tion of agricultural land in making contracts ,establishing intermediary organizations and assimilating civil con-tracts .
