破解竞技体育纠纷独立仲裁的法律困境及出路

摘　　要：目前我国竞技体育纠纷的独立仲裁制度仍然停留在法律文本上,没有实施。据其"难产"原因的分析,其面临的法律困境包括体育法与立法法中关于竞技体育独立仲裁的立法误解、竞技体育仲裁与一般仲裁的立法矛盾以及国内竞技体育仲裁与国际竞技体育仲裁的不协调等,破解竞技体育纠纷独立仲裁的法律困境及出路除了要做好竞技体育独立仲裁的制度本身的设计之外,更为重要的是首先要理顺竞技体育纠纷独立仲裁的立法依据,尽快制定完善竞技体育纠纷仲裁的相关配套立法;其次是要做好竞技体育纠纷独立仲裁与其他解纷机制的有效衔接,包括与体育行会内部仲裁、体育行政裁决、商事仲裁的衔接、法院裁判的衔接、国际体育仲裁的衔接等;再次要努力构建多元化的竞技体育纠纷化解机制。At present, the independent arbitration system of competitive sports disputes in China has not been implemented due to the fact that there is discrepancy of competitive sports independent arbitration between Sports Law and Legislation Law. There are legislative conflicts between competitive sports arbitration and general sports arbitration, between domes- tic and international competitive sports arbitration, etc. Therefore, a good design of the competitive sports independent arbitration system is prerequisite, and the legislative basis of the competitive sports independent arbitration should be es- tablished and related legislation of competitive sports disputes arbitration should be formed. Effective connection should be built between the independent arbitration of competitive sports disputes and other dispute resolution systems, including sports association arbitration, sports administrative adjudication, linkage between the commercial arbitration, court judge, cohesion of the international sports arbitration, etc. Moreover, a diversified dispute resolving system of competitive sports should be built.
