未成年人地方立法良法标准实证研究

摘　　要：近期未成年人事件频发显示出我国未成年人保护法律体系自身存在不足,制定良好的地方性法规、规章有助于弥补这方面的不足。要制定出良好的地方性法规应当确定地方立法良法的实体标准和形式标准。实体标准包括保护人身权标准、保护隐私权标准、保障参与权标准、保障平等受教育权标准和特殊未成年人的权益保护标准等;形式标准包括地方性标准、执行性标准、可操作性标准、恪守立法权限标准等。未成年人地方立法良法可以下列方式实现:通过制定执行性地方立法执行中央立法;通过创新性地方立法弥补中央立法的不足;以政策为依据制定创新性地方立法;通过组织未成年人参与地方立法实现地方立法的针对性;通过提高地方立法工作人员的立法素质实现立法的科学性等。Events show the legal system＇shortcomings for our country to protect the juvenile recently. To formulate the good local regulations can make up for the deficiency. To formulate the good local regulations shall determine the standards of the entity and the form of the local legislation. The standards of entities include the protection of the security and health,the privacy,the security,the equal right to education and the special rights for the Juvenile in the Local legislation. The form standards include the local standard,the executive standard,the operational standard and abiding by the legislative authority standard etc. The Juvenile＇good local legislation can be realized by formulating the execution local legislation to implement the central legislation,by formulating the innovation local legislation to make up for the lack of the central legislation,by formulating the innovation local legislation as the basis of the policy,by organization the Juvenile to participate in the local legislation to achieve the pertinence of the local legislation,by improving the legislative quality of the local legislative staff to achieve the scientific the local legislation,etc.
