摘　　要：在刑事案件中,若刑事加害人对被害人损失的赔偿能够表明刑事加害人真诚悔罪了,能够表明刑事加害人人身危险性有所降低,赔偿可作为酌定从宽情节减轻其刑事责任。赔偿情节对刑事责任的影响既有现实合理性,又有理论、政策依据与法律依据,赔偿情节影响刑事责任的范围可有限制地扩及重罪。赔偿情节可在审查起诉阶段、刑罚裁量阶段和刑罚执行阶段对刑事责任产生影响。In criminal cases, if the criminal offender sincerely repent, and actively fulfill the obligations of compensation to the victim, the personal dangerousness of the offender may be reduced. Criminal responsibility could decrease if personal dangerousness is relatively little or none. Effects of compensation on criminal respon- sibility are practical with theoretical, policy and legal basis. The compensation influences the scope of criminal liability may be restricted to extend. The compensation plot and prosecution, sentencing and execution of pen- alty in the review stage of impact on criminal responsibility.
