摘　　要：被保险人是受保险合同保障之人,在保险合同因各种原因被解除的情境下,应当对其利益进行有效维护。保险人的法定解除权是一种权利,更是一种限制,当且仅当在法律规定时行使。在投保人行使合同解除权时,引入被保险人参与权以维护其合理期待。在被保险人有解除要求时,赋予被保险人合同解除请求权以实现当事人间之利益平衡。the insured is protected by the insurance contract, under the circumstance of dissolution, the interest of the insured should be protected effectively. The right of statutory dissolution is not only a kind of right but also a kind of restrict. The right of the insured ＇s participation should be manipulated when the policy-holder exercise its right of dissolution. The insured should ask the contract to be dissoluted.
