体育赛事转播权的法律属性

摘　　要：采用文献资料、逻辑思维法和案例分析法对国内外体育赛事转播权法律性质界定存在的"赛场准入权说""娱乐服务提供说""企业权利说"和"商品化权说"等观点进行分析。结果显示:体育赛事转播权法律性质的多学说论和各类法律权利的交叉使得赛事转播权的归属存在着不确定性。为明确体育赛事转播权法律性质及其权利归属,需要对体育赛事转播权和体育赛事节目分开讨论,它们是2种不同性质且容易混淆的权利,2者权利归属不相同,法律保护方式有区别。体育赛事转播权归属于体育赛事参赛组织和体育赛事主办单位,是许可他人进驻比赛现场进行拍摄、转播体育赛事并获得经济利益的权利,是体育组织的无形资产,接受《合同法》和《侵权责任法》保护;体育赛事节目归属于广播组织,是经体育赛事组织授权转播体育赛事的持权转播商(包括电视台、新媒体机构)播放的体育赛事信号,具有广播组织权,其权能在于禁止他人有线和无线转播其节目信号,接受《著作权法》和《信息网络传播保护条例》保护。With the research methods of literature review, logical analysis and case analysis, the thesis ana lyzes the legal nature demarcation of sports events home and abroad and their broadcast right. The results show that the overlapping between multi doctrine theories on the legal nature of sports event broadcast right and the various types of legal rights leads to the uncertainty of sports event broadcast right owner- ship. In order to clarify the legal nature and ownership of sports event broadcast right, it is necessary to discuss sports event broadcast right and sports events separately, which are actually two different and confusable rights with different right ownership and legal protection. The broadcast right of sports events belongs to the participating organizations and the organizers of the sports events, which are entitled to granting permissions to other entities to shoot and broadcast the sports events as well as reaping the ben efits. It is thus an intangible property of sports organizations that subjects to the protection of ＂Contract Law＂ and ＂Tort Liability Law＂. Owned by the broadcasting organizations, sports event programs refer to the sports event signals broadcasted by rights holding broadcasters which are authorized by the sports e vents organizers （including television stations and new media agencies）. They have the right of broadcast ing organizations,which includes prohibiting others from relaying their program signals through wired or wireless broadcasting and subjecting to the protection of ＂Copyright Act＂ and ＂Regulations on the Pro tection of Information Network Dissemination＂.
