摘 要:随着政府公共管理从线性模式到复杂模式,从稳定运行到动态治理,从政府创新到社会协助,全球都步入到一个以电子媒体为主体的时代。电子政务的蓬勃发展推进了电子智力体系和信息处理能力的现代化演进,并利用先进的科学技术和社交媒体向公众提供着更加有效、便利的公共服务,增加了公众对政府电子化和信息化的依赖。另一方面,电子政务的高信息化又引发了公众对于信息开放以及信息安全的担忧。从爱德华·斯诺登事件中,以美国为首的西方国家利用信息技术和手段窃得的数据和资料已经给涉及国家带来了重大的政治影响和经济损失,也极大地危害了国家的利益与安全。因此,要想在当今世界格局中掌握先机,就必须从国家战略层面、法律层面以及技术层面给予相应的支撑和协助,保护国家安全,维护个人利益。本文在分析了电子政务信息安全法律现状的基础上,对比欧盟和美国等西方国家经验,提出了我国电子政务领域中信息安全的法律问题,并给出了相应的对策和建议。With the development of public management from linear model to complex model, from stable running to dynamic admin- istration, from government innovation to public assistance, the whole world has entered into the time of electronic media. The prosperity of e-government promotes the modernization of intelligence system and information processing capabilities, and also provides more effective and convenient public services to the society. While, on the other hand, frequent usage of e-government information and transparent date also arouse security concerns. Take Edward Snoden for example, the western countries use high-technologies to steal other countries" core data that bring significant political influence and huge economic loss, and also greatly harm to the security of the stolen ones. Therefore, how to pick up legal weapon to protect interest of public has become an effective way to solve problems. Based on the analysis of legal status of information security on e-government, this article compares the experience of European Union and U.S., proposes the current problems of Chinese e-government information security, and also gives the corresponding suggestions.
