主要发达国家自然垄断行业监管机制嬗变的适用性分析及对我国的启示

摘　　要："嬗"字顾名思义,本义为:缓。所谓"嬗变",即自然的演变,如特征或条件的彻底改变。嬗,多体现为一种客观的、外在的、规律性的发展变化。纵观自然垄断行业监管机制所经历的监管迷信、监管质疑、监管重构三个阶段,可以发现,一方面,监管机制嬗变的理论假设来源于对经验事实的观察,另一方面,经验和事实也是对监管机制嬗变理论的一种检验。机制的嬗变准确地说是一种主观见之于客观的表现,既随着技术进步、市场规模及范围、自然垄断合理性及其边界的动态变化,在客观上进行不断调适,同时也因各国国情、政府监管理念的差异,在机制选择、运用上呈现主观诉求。对自然垄断行业政府监管机制嬗变及其适用性的分析,应充分咀嚼世界范围内的监管改革经验,掌握借鉴监管机制调整及适用的一般规律;更应结合本国实践,结合政府监管机制改革的多元目标,将先进的监管机制移植于特殊国情之上,努力使之本土化。Shan,as the name suggests,its original meaning is slow.The so-called Shanbian,or we can call it natural evolution,such as some thorough changes in characteristics or conditions.Shan often manifests as objective,external and regularity development as well as changes.Throughout the three stages that the regulation mechanism of natural monopoly industry has witnessed,those are regulation superstition,regulation questioning and regulation reconstruction,we can find that,on the one hand,hypotheses of the evolution theory in regulatory mechanism originate from the observation of empirical facts;on the other hand,the experience and fact is also a test of the regulatory mechanism evolution theory.In accurate,mechanism of evolution is a performance that can be seen in objective perspective from the subjective perspective.It will make continuous adjustment objectively with the advance of technology and the dynamic changes of market scale and scope as well as natural monopoly rationality and its boundary.It will present appeals subjectively in the selection and the application of mechanism according to different national conditions and government supervision ideas.When analysing the govermental regulatory mechanism evolution of natural monopoly industry and its applicability,we should fully chew the experience of worldwide regulatory reforms and master the general law for the adjustment and the application of regulation mechanism;we should also transplant the advanced supervision mechanism on the special national conditions and make it localization by taking their own practices and the multivariate goals of the government regulation mechanism reform into consideration.
