我国留地安置的制度困境与法律保障

摘　　要：一些地方政府推行的留地安置制度存在着留地权属不清、留地比例的标准不统一、留地用途难以确定等困境。要提高立法层级,完善留地安置相关立法;改革土地征收补偿制度和土地增值利益分配制度;完善农村土地使用权的流转制度;加强地方政府财政收入体制配套改革。The land usufruct returning system implementated by the local governments remains in dilemma,such as the unclear ownership, the not uniform proportion of standards, the difficult to determine＇ s leaving land use and so on.So it needs to reform and improve the land usufruct returning system.Crack the land usufruet returning system＇ s dilemma is plaeed： First,to improve the legislative level and perfect the land usufruct returning system＇ s relevant legislation; Secondly, from the reform of land acquisition compensation system and land value-added benefit distribution system, improving the rural land use rights＇ circulation system and local government revenue system and so many aspects to strengthen the reform of supporting systems.
