负面清单与我国行政审批制度改革问题研究

摘　　要：随着负面清单的试点和推广,未来我国或将形成负面清单为主、行政审批为辅的外商投资管理制度,以及负面清单占重要地位的社会管理制度。同时在明晰负面清单管理模式的构成要素及特征的基础上,认为其推广面临基础薄弱、地方保护主义和部门利益的阻碍。但总体来说"负面清单"管理模式有着营造良好的对外经济发展环境,促进社会管理水平与经济发展水平协调发展,创新和完善国家治理体系的重要作用。With the development of negative list, the system of investing management of foreign investors may be constructed, including both negative list and administration examination. Meanwhile, based on the clear structure of negative list management system, we argue that it faces the obstacle of fragile basis and local protectionism. In fact, negative list management system plays an important role in building a healthy environment of economy developing, contributes to the development of social management, and completes the governance structure.
