摘 要:作为新兴的商事法律制度,近代中国商标法制建设经历了西方先进的商标法制与本国传统商业习惯的冲击与融合。在其发展历程中既形成了独特的个性,同时也在历代政府的不断调整和完善中取得了令人瞩目的成就,成为商人进行商业活动必须依据的法律规范,对社会经济发展产生了巨大的促进作用,具有积极的进步意义。当然,作为社会环境下的产物,也不可避免地带有时代烙印,留有一些不足,从而为我们今天商标法律制度的建设带来了启示。As a new commercial law system, modern Chinese trademark law has not only a unique personality in the course of development, but also remarkable achievements, have been made because governments constantly adjusts and improves it. It has become the legal norms in the transactions, and exerts great influence on the social and economic development. Of course, as a product of the social environment, it has inevitably some shortcomings, which has brought about the inspiration and reference for the construction and development of trademark law.
