涉农犯罪的基本形态及防范对策

摘　　要：涉农犯罪是以农村、农业、农民为侵害对象的犯罪,主要指涉及危害农村社会稳定、破坏农业生产和损害农民利益的行为。它主要包括坑农害农犯罪、破坏农业生产犯罪、农村土地犯罪、农村职务犯罪、破坏农村民主管理犯罪以及败坏农村社会风气的犯罪。涉农犯罪的形态具有一定的社会基础,如不重视农业、不重视农村建设、农民的弱势化以及农村基层组织涣散等。因此,防范涉农犯罪的基本对策主要应从重视农业、重视农村基层建设、培育农民公民意识、提高农民文化素质以及强化农村社会控制力量等几个方面入手。Agriculture -related crimes refer to those crimes whose infringement objects are rural area, agricul- ture and peasants. The behaviors of such crimes mainly weakened the stability of rural society, destroyed agricultural production and damaged peasants＇ interests. They include crimes of agricultural damage, crimes of destroying agricultural production, crimes of damaging peasants＇ interests. Agriculture - related crimes have certain social foundation which show up as the negligence of agriculture and agricultural construction, the weakness of peasants and the slackness of rural grassroots organization. Therefore, the following countermeasures should be adopted in order to prevent agriculture - related crimes, i. e. , attaching importance to agriculture and the construction of rural grassroots organization, cultivating the citizen sense of peasants, improving cultural quality of peasants and strengthening the control power of rural society.
