论足球俱乐部退出后球员劳动权保护之完善——以“大连实德退出事件”为分析背景  

On the Perfection of Football Player's Labor Rights Protection after the Football Club Exiting from Football League——From the Background of "Dalian Shide Exiting Event"

摘　　要：依托于劳动合同法的基本理论,足球俱乐部在退出职业足球联赛后,俱乐部与球员双方继续履行劳动合同的竞技基础已经丧失,球员不再受到原有劳动合同的约束而应成为自由球员。中国足协对"大连实德退出事件"的处理决定影响到实德球员从事足球职业的机会,实质上是限制了球员的抽象性劳动权。完善对球员劳动权的保护,应当明确"足球俱乐部退出职业联赛后其球员成为自由球员,且其他足球俱乐部引入退出俱乐部的球员不受转会名额的限制"。Rely on the theory of labor contract law, after the club exiting from football league, the athletics basics for players to per- formance of the labor contract has lost, so the players must become free players and are no longer bound by the labor contract, and other clubs Chinese Football Association~ decision of ＂Shide Event＂ has influence the opportunity for players to get a job which essentially limits the abstract labor rights of Shide players. With the considerations of the protection of players＇interests ,when foot- ball clubs exit from football league, players of these clubs will become to free transfers, other clubs moreover can buy their players without limitation of transfer amount.
