摘　　要：随着全球体育法治实践的深入,Lex Sportiva作为一种正在形成的法律秩序为"全球法"理论提供新证据。就学界对Lex Sportiva归属何种法律体系的争论进行梳理,排除Lex Sportiva属于"国家法"和"国际法"的可能,并论述"习惯法"理论对于分析Lex Sportiva的局限性。认为:应将Lex Sportiva视为"全球体育法"及"全球法"理论新的例证。As a legal order being formed, Lex Sportiva provides a new basis for the theory of ＂global law＂. The study has analyzed the legal nature of Lex Sportiva, stating that it is neither a national law nor an international law. Also it discusses the limitation of the theory of ＂common law＂ in the analysis of Lex Sportiva. The study holds that Lcx Sportiva should be considered to be a＂ global sport law＂ and it provides a new evidence for ＂global law＂ as well.
