摘　　要：主要从数字取证及其所形成的电子证据的角度，对电子证据的取证技术、取证标准及取证程序等进行了阐述，并对我国数字取证及电子证据所存在的相关及司法问题即数字取证工具、取证人员、取证流程及取证相关立法进行了分析并给出了相关司法解决的建议。From the perspective of digital forensics and its electronic evidence, this article mainly discussed forensics technology of electronic evidence, forensics standard of electronic evidence and forensics procedure of electronic evidence. Furthermore, it analyzed the existing problems of digital forensics and electronic evidence and relevant judicial problems in China, including issues of digital forensics tools, forensics personnel, forensics procedure and relevant leg islation. And it gave the relevant judicial solution proposals as well at the end of this article.
