摘　　要：电子数据证据作为科学发展与信息技术的产物，其证明案件事实的作用日益凸显。它的出现也给司法实践中证据的审查判断带来了新的问题，对传统证据规则构成冲击。然而，我国在电子数据证据方面的立法比较匮乏与滞后，也很少涉及其审查判断规则，导致电子数据证据的适用受到较大的阻碍。对国内外电子数据证据传闻、非法证据排除、补强证据、最佳证据规则的学说与相关规定进行对比，从法院与检察院角度研究其实践应用，结合电子数据证据审查判断的监督体制，以期提出完善我国电子数据证据审查判断规则的设想。The electronic data evidence is a result of the scientific development and information technology. Its effect on proving the facts of the case becomes more and more obviously. There are deeper researches into it in academic cir cles. Its appearance also brings new problems of reviewing evidences in judicial practice. It will necessarily bring the impact of traditional evidence rules. However, in our country, the lack and lag of the electronic data evidences legisla tion and rules of reviewing Evidences block the application. The thesis will contrast the domestic and foreign rules of electronic data evidences, such as Hearsay Rule, Illegal Evidence Exclusionary Rule, Corroboration Rule and Best Evi dence Rule. To research its applications from the perspective of the Court and Procuratorate and we can find the su- pervision system of reviewing electronic data evidences. So, I can give some assumptions about the rules of reviewing electronic data evidences in our society.
