摘　　要：生态型政府是政治生态文明理念下政府范式转变的必然选择,但我国生态型政府的构建却面临着组织、市场、主体、法律等困境。因此,迫切需要从以下几方面着力解决:建立动态组织、转变政府职能、合理配置权责,完善政府生态管理的组织建设;加强市场理论研究、深化市场经济体制改革、培育生态市场,积极发挥市场作用;培育生态NGO、改善信任格局,推动主体间多元化和一体化的合作进程;坚持正确的立法理念和立法原则,改变执法体制,加强执法权威,完善司法问责和司法救助体系,提高法律保障的有效性。Ecological government the inevitable choice of the government paradigm shift in the concept of political ecological civilization. But the construction of ecological government of our country is facing many difficulties such as organization and market, the main body, legal. Therefore, there is an urgent need to strive to resolve the dilemma from the following several aspects： establishing a dynamic organization, the transformation government function, the rational allocation of power and responsibility, to improve the ecological management organization construction; strengthen the market theory research, deepening the reform of market economic system, cultivating ecological market, actively to play a role of the market; cultivating ecological NGO, improving trust pattern, to promote cooperation between diversity and integration of the subject; adhering to the correct legislative concept and legislative principles, changing the law enforcement system, strengthen the law enforcement authority, perfecting the judicial accountability and judicial assistance system, to improve the effectiveness of the legal protection.
