摘 要:随着"权利"时代的来临,我国国家治理模式逐步由政府单一管理转为由政党、市场和社会组织等主体共同治理,国家与社会以及劳动者的关系也在进行调整。这对工会职能的拓展与完善提出了新的要求。顺应这些要求,我们必须完善工会立法,强化工会协调劳动关系及其代表和维护劳动者权益的职能,淡化工会的政治色彩,增强工会代表性和独立性;要针对不同层级的工会进行相应的制度安排,并严格保障工会的权力运行,让工会参与国家和地方立法、政策制定、参与民主管理和平等协商的权利落到实处,最大限度地维护职工的各项权益。With the coming of the age of 'right', China's national governance mode has gradually changed from a single management to a new joint governance mode by political parties, social organizations and other main market participants, and the relationships between the nation, the society and the laborers are changing. These changes bring some new requirements for the function development and improvement of Chinese Trade Unions. To meet these requirements, we need to improve the legislation of the Unions, to strengthen trade unions' functions of coordinating the labor relationship and protecting the rights and interests of laborers, and to lower the trade unions' political color, and also to enhance the unions' representativeness and independence. Meanwhile, we must design proper systems according to the different levels of trade unions, and protect unions' operation power, in order to make sure that the unions can really participate in the national and local legislation, the policy formulation, the democratic management, and the equal consultation, maintaining the rights and interests of the workers to the maximum extent.
