摘 要:环境监管的公众认同是社会公众对于环境治理及其效果的认可和接受。公众认同之于环境监管,在促进环境立法和政策的制定及实施等方面具有重要的作用和意义,但对处于转型期的中国,从实践个案的角度以及法律规则的层面进行分析,环境监管的公众认同仍存在诸多障碍,亟须化解。环境监管公众认同的实现路径有赖于监管理念和监管制度的共同作用。一方面,通过引入"多中心主义",化解环境监管的理念困境;另一方面,应着重从公共事件阶段、有序参与阶段和决策落实阶段等公共参与的三个阶段来加强和完善环境监管的信息披露制度和程序性保障制度,以此化解环境监管的制度困境。Public recognition of environmental regulation is the public approval and acceptance of environmental governance and its effects. In terms of the advancement of environmental legis- lation and policy formulation & implementation, public recognition is of great significance to en- vironmental regulation. But in transitional China, the analysis from a perspective of practice cases and at legal rule level shows that there are many obstacles to public recognition of environmental regulation and it is urgent that we solve these obstacles. The route to realize public recognition of environmental regulation depends on the combination of regulation ideas and systems. On the one hand, a solution to the idea plight of environmental regulation depends on the introduction of pol- ycentrism; on the other hand, a solution to the institutional plight of environmental regulation relies on the reinforcement and perfection of information disclosure and procedure guarantee sys- tems of environmental regulation at three stages of public participation, namely public event stage, orderly participation stage and decision-making enforcement stage.
