政府放权与馆长“交权”——公共图书馆法人治理结构中的两个关键点

摘　　要：公共图书馆建立法人治理结构后由图书馆理事会行使决策权,这需要政府放权和馆长"交权"。但从几年的试点情况来看,政府放权并不彻底。一方面,国家相关文件的规定还为政府留有余地;另一方面,政府代表在图书馆理事会中扮演着重要角色。政府的做法影响了实行公共图书馆法人治理结构的成效。同时,馆长的身份由法人代表转变为向理事会负责的执行者,其角色转变的难度仅次于政府。然而,馆长必须从大局出发,服从于这一制度安排。The decision-making power of the public library exercised by the board of trustees after the public library built the corporate governance structure, which needs the government to delegate the power and the library director to relinquish the power. But from years of the pilot situation, the government doesn＇t delegate the power completly. On the one hand, regulations of relevant national documents also leave room for the government; on the other hand, the government representative plays an important role in the board of trustees. The practice of the government has influenced the effect of implementing the corporate governance structure of the public library. Meanwhile, the identity of the library director has changed from the legal representative to the executor responsible to the board of trustees, and the difficulty of the role change next to the government. However,the library director must proceed from the overall situation and obey the institutional arrangement.
