摘  要:大众传媒对私领域侵蚀的风险伴随传媒技术的时代进展而加剧。新媒体技术逻辑强化了传播内容的涉私性,导致隐私侵权的可救济性弱化。均衡鼓励新媒体技术的应用与隐私人格利益保护之间关系,隐私权保护规则应确立如下原则,即以人格尊严与伦理价值作为要件庇讳隐私,以主体不同身份角色与所处境遇确立隐私外延差异,以社会对涉私的违德行为可容忍度为依据判别隐私正当性。Advances in media technology cause risk to privacy protection. Compared with the traditional media, new media' technology logic not only strengthened the diffusion involving private information, but also give impact to inherent judicial idea on privacy . Reestablishing reasonable scope and range of privacy will be help to get rid of the dilemma that privacy law is put on hold, and to balance the relationship between encouraging the application of new technology and interests of protecting privacy. Rationality of protection privacy should obey the following rules: differently treating according to different roles and situation in the privacy, fully respecting the autonomy and self-discipline in typical private fields, giving asylum to human dignity for those non personality factors of dissent , setting bottom line to respecting the privacy right if contrary morality can be tolerated by society.
