平行破产程序法律协调之比较研究及借鉴

摘　　要：在跨界破产案件中,平行破产程序已经成为一种司空见惯且无法回避的法律现象。基于平行破产程序之间的冲突在所难免及其负面影响显现,平行破产程序之间的法律协调势在必行。本文在分别考察有关国际性组织、区域性组织以及主要发达国家平行破产程序的立法规定的基础上,进行比较研究,甄别优劣差异,进而提出中国平行破产程序法律协调的对策建议。The parallel bankruptcy procedures have been a quite common and unavoidable legal phenomenon in cross-border insolvency cases.Since the conflicts among parallel bankruptcy procedures are unavoidable and their negative effects appeared,the legal coordination of parallel bankruptcy procedures is imperative,Based on respectively studying the legislations of the relevant international organizations,regional organizations and main developed countries,this article takes a comparative study on them,and discriminates them and then puts forward countermeasures and suggestions for China＇s legal coordination of parallel bankruptcy procedures.
