摘 要:当前,由于立法始终未能解决有关民事检察监督立场、程序设计、制度要素之间关系如何处理等问题的争议,民事检察监督的具体操作程序始终不明确,导致民事检察监督实践以民事申诉制度立法内容为"标杆",在实践中产生了不少问题和误区。应从系统论的要求出发,对民事申诉制度与民事检察监督制度的整体架构深入反思,予以改良,如此才能促进民事申诉制度与民事检察监督制度充分发挥各自制度优势,共力实现立法预期的民事审判监督制度的整体价值目标。The civil appeal and procuratorial supervision systems are closely related to each other. The civil appeal system can greatly influence the position, scope, content, scale, and attitude of the civil pocuratorial supervision system. At present, due to the fact that legislation has never properly resolved the relations between the position of civil procuratorial supervision, its program design and the components of the whole system, the specific operating procedure of civil procuratorial supervision remains ambiguous, resulting in problems and mistakes in practice; for example, the contents of the legislated civil appeal system has been taken as the "benchmark"for the practice of civil procuratorial supervision. It is, therefore, suggested that retrospection and reform should be done by taking the civil appeal and procuratorial supervision systems as a holistic and inter-related matrix, so that each individual system can respectively play its own role and the expected value of the civil pocuratorial supervision system can be implemented from the legislative point of view.
